Terms and Conditions
These Standard Terms of Service (“Terms”) apply to the services (as defined below). References in these Terms to “us” or “we” or “our” or “HYFLY” refers to HYFLY References to “you” or “your” or “the Customer” refers to the party making a Booking with us. When placing a Booking with us, you acknowledge and agree to the terms and conditions set in these pages.
Your order for private hire transportation services as conveyed to us via our website, email, or over the phone and accepted by us is referred to as a “Booking.” “Driver” refers to the specific private hire driver who carries out the Driving Services on our behalf. “Driving Service” refers to the transportation services provided by HYFLY and carried out by the Driver on our behalf in response to your Booking. To be clear, Driving Services may entail the transportation of passengers and/or the couriering of objects. “Fare” refers to the cost payable to HYFLY for the Driving Services. “Vehicle” refers to the car that the Driver is driving.
You accept and agree that: These Terms apply to all Bookings. When we accept a Booking, a contract is formed directly between you and HYFLY. HYFLY enters into this contract as principal and is legally responsible for providing the Driving Services. Drivers carry out the Driving Services on behalf of HYFLY and are not parties to the contract between you and us.
HYFLY will provide you with Booking services with reasonable care and expertise. HYFLY may present you with an anticipated travel time for your journey while providing the Booking service, but this is solely for guidance. It is your obligation to allow enough time for the journey, and you should factor in extra time for delays and unexpected events if the journey is critical, especially if subsequent connections and/or appointments are at risk of being missed. When making a reservation, you must specify the appropriate car size for the number of guests and luggage. We cannot guarantee that we will be able to transport excessive amounts of luggage. Please keep in mind that a child, regardless of age, counts as one passenger. If you or a member of your group requires a wheelchair, please note this when making your reservation. Please be advised that, depending on availability, a vehicle capable of transporting a wheelchair user may have a lengthier wait time. If you would like to request a specific vehicle type and/or Driver for your Booking, we will do our best to meet your demands, but we cannot always promise that they will be met. If the request cannot be fulfilled, we will notify you at the time of booking.
All bookings must be made on the website and paid by card. If our booking system is unable to process your card for any technical reason, we may be able to assist you over the phone. All payments are made to HYFLY. Where authorised, a Driver may accept payment from you on behalf of HYFLY. We supply you with a fixed fare at the time of Booking, based on the information you provided. The Driver will provide the Driving Services for the specified Fare if the initial Booking does not include additional drop-offs, pick-ups, route or destination changes, or additional waiting time (save for airport pick-ups, which include a standard 30-minute wait). If changes occur after a Booking has been made, any revised Fare will be agreed with you by HYFLY.
During the ride, you are responsible for the behavior of all passengers in the Vehicle. In the event that the Vehicle is soiled by any passenger, you will be charged the applicable soiling fee in line with the relevant local authority guidelines. Eating, drinking, vaping, and/or smoking is strictly not allowed in the Vehicle.
If your journey originates from an airport, you must give us all flight information at the time of booking. Unless you specify otherwise, we will enter the terminal 30 minutes after your aircraft arrives to give you enough time to clear customs and retrieve your luggage. If you are not present 30 minutes after the Vehicle has entered the terminal, waiting time may be charged at the usual rates. If you’d like to arrange a different pick-up time or method, please let us know when you make your reservation. HYFLY may check for airline delays before the Driver departs for the airport but is not obliged to do so. The Driver will be dispatched based on the scheduled pick-up time for pre-booked airport journeys. We reserve the right to charge a cancellation fee if you cancel the Booking within two hours of the scheduled pick-up time.
HYFLY does not provide child seats. Requirements relating to child seats are governed by applicable UK law. HYFLY is unable to provide child seats for health and safety reasons. Where a child seat is required, it is the responsibility of the parent or guardian to supply and correctly install the seat. HYFLY cannot provide services to unaccompanied minors unless expressly agreed in advance
If you need to cancel your reservation, please contact us as soon as possible. If you cancel a Booking after the Vehicle has been dispatched, you may be charged a fee calculated based on the distance and/or time already incurred. HYFLY may be forced to cancel a Booking due to circumstances beyond our control. If this happens, we will provide notice where possible and refund any money you have already paid for services not received. cancel a Booking before the scheduled pick-up date owing to reasons beyond our control. If this happens, we will give you as much notice as possible and issue a refund for any money you have already paid.
If an occurrence beyond our control affects our ability to provide the Driving Services, we will notify you as soon as feasible and take reasonable steps to minimise any delay. HYFLY is responsible for providing the Driving Services with reasonable care and skill. We are responsible for any loss or damage you experience that is a foreseeable result of our failure to comply with this contract or to exercise reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was apparent that it would occur or if both you and we knew it might occur at the time the contract was formed. Where it would be unlawful to do so, we do not exclude or limit our liability, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. We are not liable for business losses. The services are provided for private use only, and we will not be liable for loss of profit, loss of business, business interruption, or loss of business opportunity.
Your personal information will only be used in accordance with our Privacy Policy, which is available on our website.
HYFLY reserves the right to modify these Terms at any time by posting updates online. The Terms applicable at the time of Booking will apply to that Booking. This agreement is between you and HYFLY. Each paragraph operates independently. If any part is found to be unlawful, the remaining parts shall remain in full force and effect. These Terms are governed by English law. You may bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home jurisdiction.
